Guns have always been a sure way to protect yourself and your home, although things have changed quite a bit over the years. Even though those who live in the United States have a right to bear arms, there are also certain responsibilities that come along as well. Those who own guns have the responsibility of protecting their home and their family – and also their guns. Anyone who owns a gun may have self-protection in mind – although he also has a priority to protect his guns as well.

Gun Security

Anyone who owns a gun should never allow them to fall into someone else’s hands. To ensure this never happens, the gun owner should always keep his gun collection locked away in a safe or gun cabinet. You can get many different sizes of gun safes, that will hold a variable amount of guns. Anything can happen if the wrong individual gets a hold of your guns, which is why you should always make sure they are well protected – and locked up.

For ultimate home security, you should have a gun within your reach at all times. At the same time, you have the responsibility of making sure no one else has access to this gun. For this reason, it is best to keep it on your person and loaded whenever you are at home.

Gun owners can protect their own property as well, by storing their guns in fireproof gun safes. Fireproof gun safes for home can protect guns and keep them safe, even if everything else burns to the ground. Even though gun owners have the responsibility to keep their guns out of the reach of others, they also have the right to ensure that no harm comes to their guns as well.

Child Security

Fireproof safes for the home will also keep guns safe from children. All children are curious and like to get their hands on anything they can. If you leave your guns lying around and not locked up, a child will eventually find it. You should also ensure that your guns are never loaded either, as a child can really hurt himself if he finds a loaded gun. Although you may keep your guns locked up in a fireproof safe – you should also make sure that the ammo is out of the guns and locked away in the safe as well.

Keep in mind that children may look for your gun on purpose, knowing that the guns are something that you use. Therefore, simply putting your guns on a higher shelf doesn’t really protect your children. If a child wants something bad enough, he or she will do anything possible to get it. The only real way to keep your guns safe from children is to ensure that they are always locked up in fireproof safe, in a traditional gun safe, or on your person (ie. a holster on your belt).hdx-150-closed-liberty-logo-2971368

Children may show interest in guns at an early age, which can be a good thing but can also be a bad thing. At a young age, a child won’t know anything about gun safety. Therefore, if a child happens to come across your guns, bad things can happen. If you have guns if your home, you should always make a point to teach your children about gun safety. This way, they will know that they aren’t allowed to handle your guns, and they’ll be aware of what can happen if they do.

By keeping your guns in a fireproof safe or traditional gun safe, you’ll keep your guns safe from children or others. Fireproof safes will also keep your guns safe from fire as well, which makes them an ideal investment. Although you can also get a traditional gun safe if you prefer, fireproof safes are by far the best way to go. You can keep your guns safe from children, others, and even fire – which makes them more than worth the money.

At the end of last week, a USCCA team member sent me this repulsive, grossly inaccurate article by Fred Grimm of the Miami Herald.

As you can imagine, Grimm’s words made me sick to my stomach.

See, I’ve spent the better part of 20 years building the USCCA and standing up for honest, responsible, law-abiding gun owners. So when someone negatively paints those people — people like you and me — with sweeping generalizations and straight-out lies, I can’t help but take it personally.

Luckily, nearly every comment in response to Grimm’s article called him out for his erroneous portrayal of responsibly armed Americans.

I especially loved what James S. had to say:
“Grimm, your deplorable article buries the important point that these policies will not cover felonious activities. But emphasizing that point would undermine your hit piece. Can’t let the facts get in the way of a good smear.”

Thank God for people like James.

But don’t worry: He wasn’t the only one who had your back on this.

See, I wasn’t about to sit around and allow a guy named Fred Grimm to sit atop his media pulpit and recklessly tarnish the good name of the USCCA or our amazing, responsible community of gun owners. So I decided to send over a letter to the editor. Unfortunately, Miami Herald limits such responses to 200 words, so I had to keep it brief…but I think you’ll get the gist.

Here it is:

As President of the USCCA, I would like to respond to Fred Grimm’s irresponsible, misleading attack on our 180,000+ law-abiding members.

In “Shoot somebody? This hotline’s for you — for a fee,” Grimm insinuates that buying a self-defense insurance policy gives Americans free rein to commit crime, going so far as to say that it actually encourages them to do so: “With one of these policies, some gun owner who might have hesitated before pulling the trigger can come out blasting.”

The truth? An individual’s insurance policy doesn’t curtail law enforcement’s right to investigate (or prosecute) a crime. In the case Grimm cited, law enforcement conducted a thorough investigation and cleared the individual in question, who was simply exercising his God-given right to self-defense.

I would have welcomed a conversation with Mr. Grimm about our membership benefits or the right to use a firearm in self-defense, but he did not contact the USCCA before spewing gross untruths about the most law-abiding segment of Americans. Perhaps he should focus his ire on criminals who unlawfully use firearms instead of responsible men and women who are, quite honestly, sick of being painted as “bad guys” for rightly defending themselves and their loved ones.

I hope Mr. Grimm reaches out to me so that I can set the record straight on what our membership really means and what types of people really own and carry guns for self-defense (Hint: They’re undeniably the GOOD guys!).

I also have a small favor to ask of you.

When you come across untruths like the ones in Fred Grimm’s article, do everything in your power to fight back:

Stand up for yourself and for others like you. Stand up for what you believe. Stand up for the truth. Stand up for the USCCA.

As for me … I promise I’ll always stand up for you.

Gun Laws Don’t Work On Criminals

I have heard more comments in the past few days that people “don’t need assault rifles” than I have heard in the last several years combined! I still find it puzzling that someone can kill that many people and everyone jumps straight to attacking guns.

Why do we not scream to ban vehicles every time someone is killed by a drunk driver? Why are the penalties not harsher for people who drive a vehicle without a license? Isn’t that the government’s way of making sure people know how to handle a large piece of metal that can travel 100 mph. When this happens we blame the driver, not the car.

I am guessing the reason for this is because the car is … driven and operated by a driver. It did not drive into someone on its own and it does whatever its driver tells it to do. A gun is no different. Some would argue that guns were made to kill people and cars were not, but I would argue that guns are made and it is up to the owner of each gun to decide how it will be used. If you look past the gun, you still come back to the issue many people want to avoid. Why are people going on killing sprees all over the country?

I am not convinced that a restriction on guns of the citizens (who follow the law) will keep anyone from killing people if someone is determined to do so. Murder is “prohibited” by the government and yet people kill. Stealing is “illegal” yet people steal every day. Not one person has ever been saved by a “no guns allowed” sign, and telling a criminal who wants to kill someone that he is not supposed to have a gun, will not keep him from getting a gun and killing someone.

We find guns on drug dealers all the time and very seldom is that gun purchased by the drug dealer. Why don’t the drug dealers just buy a gun? Because felons cannot buy guns, and look how much that law has helped us. The mass media is focused on how the shooter bought a “legal” gun. Either way he got a gun and killed people. He obviously did not care about any laws so a law saying “no, no” to a gun would not have stopped him.

I am all for criminal checks being done before someone buys a gun from a gun dealer, but if a Vernon County “not so smart” drug dealer can get his hands on a gun, then anyone can. Even if all guns in America could be taken away, a would-be killer will just find some other way to carry out his will.

I have seen inmates in jail make dangerous weapons out of toilet paper roll inserts, empty shampoo bottles, and deodorant sticks. Several years ago there was a detention officer killed in a county jail with a toothbrush that had been ground to a point and then taped to the end of a newspaper using the barcode labels from deodorant sticks as tape. They have nothing but time on their hands, and the human mind can become very creative given enough time.

The truth is, no one can know for sure if someone is going to make the decision to kill another person. We can look for warning signs, we can attempt to deter by laws of punishment, and we can try and change a person’s thinking by teaching, but we cannot control a person’s mind. The person kills, not the gun.

What we do take away with a weapons ban, however, is a person’s ability to protect their family. And yes, I would say an AR-15 style weapon is included in that list of self-defense weapons. If you can say that all you need is a little pocket sized handgun to protect your family and the government will do the rest, then I have one question. If the government cannot even manage their bank account, then are you really willing to let them protect your family from every mad, crazy person out on the streets?

Should I Own A Gun?

Over the last decade, the number of individuals obtaining a concealed carry permit has skyrocketed, and that’s a good thing. The concealed carry movement has bolstered support for the Second Amendment, introduced legions of new shooters to the world of firearms and proven that legal gun ownership does not create spikes in crime rates (just the opposite, in fact).

Perhaps most importantly, the boom in concealed carry has preserved the personal liberty of millions of Americans by allowing them to defend themselves against those who would inflict harm upon them. As a result of this new wave of shooters, and the threat of having our Second Amendment rights being taken away by the current political climate, gun sales have risen dramatically. The topic of concealed carry firearms has become a watercooler topic in workplaces around the country.

Choosing a firearm for concealed carry is an important decision, to be sure. But it isn’t the only decision you’ll have to make when you obtain your concealed carry permit, and it may not even be the most important decision. Here’s a look at six other critical decisions you’ll have to make when you obtain your CCW permit, all of which are critical to developing an effective personal protection plan.

Mindset

No matter what gun you carry, no matter the ammo is in the chamber, no matter your skill with a firearm, you won’t survive a deadly concealed carry encounter unless you have the right mindset.

The dean of developing a personal defense mindset was the late Col. Jeff Cooper, founder of Gunsite Training Academy in Arizona. Cooper left behind a great deal of information on his views regarding the topic, which are available through his videos and writings, but the primary thrust of his teaching is that evil can find you today.

Dave Grossman wrote a book entitled “On Killing”, which I recommend knowing if you have the right mindset and are fully aware of what can, and will, happen if you are confronted with the “fight or flight” situation.

No one is immune to violence, and neither the neighborhood we live in nor the circles we keep insulate us from the reality that death may come knocking anywhere and at any time. And you need to know what to do if that happens. The proper mindset is, in my opinion, vastly more important than firearm selection. Sure, you need a good gun that works properly, but no gun will do the task required if your brain fails.

If I find myself in the midst of a violent encounter, I want to know that I am more prepared to survive based on my mental state than my adversary. It might be a thin line between tragedy and survival.

Training

If you’re going to invest in a firearm for concealed carry, you must also invest in the training required to handle that gun in a safe and effective manner. For some, this means spending time on the range after purchasing a firearm, and you’ll need to carve out at least a few hours twice a week to stay sharp and develop the muscle memory to become a competent defensive shooter.

For others, advanced training is something they find necessary to be prepared for a defensive situation in the real world. It means being ready and able to protect yourself and others when you are confronted by an attacker anywhere you happen to be. This is where tactical training comes in. You should be trained to move to cover or concealment and fight on the move when needed.

The best instructors are patient and are willing to help, quick to point out the issues that can become real problems if left unaddressed. There are three keys to effective training—find a qualified instructor, listen carefully to what they say (leave your ego behind) and practice what you’ve learned. If you do these things, you will be much better prepared to defend yourself, regardless of the gun you carry concealed.

Your concealed carry firearm is simply a delivery system to propel a projectile at an attacker. In short, your defensive handgun fires a bullet but it is the bullet that serves to neutralize the threat. Why, then, do so many people choose to buy an expensive firearm and load it with cheap ammunition that was designed for target shooting and not personal defense?

There are a lot of differing opinions about what caliber ammunition is best for self-defense ammunition; .380 vs 9mm vs .40 S&W vs .45 ACP vs .357 Magnum vs .44 Magnum, etc. My personal choice when I became interested in carrying full time was the 9mm. The reasons being that most law enforcement agencies were using it. If it worked for them, it should work for me too. And if I had to use my gun, the courts couldn’t find fault with my choice of ammo.rounds-300x225-8003813

Hollow Point vs Solid Projectile

Hollow point ammo is designed to crush as it enters an object, therefore not going all the way through. This is why police use it, to prevent innocent bystanders from getting hit with a bullet that goes all the way through a bad guy.

There are a number of excellent personal protection loads for concealed carry from Federal, Nosler, Hornady, Remington, SIG Sauer, Barnes, Winchester, Browning, and others, and Federal recently unveiled its new Practice/Defend ammo packs that contain 100 rounds of practice ammo and 20 rounds of defensive ammo in one package.

It’s never seen unless I want it to be.

Holster

Finding a holster that fits your shape and lifestyle can be difficult, but this is a critical decision. Your gun is only as effective as it is accessible. If you can’t get your gun drawn and fire in a hurry, then you won’t be able to adequately defend yourself. I’ve even talked to several people who, after obtaining a concealed carry permit, don’t carry because they can’t find a comfortable holster.

The holster’s main purpose is to hold the gun close by and protect it from the elements. It also keeps the gun held in a safe manner so you don’t get shot accidently. [By the way, the common belief is that there is never an accidental discharge of a firearm, only negligent discharges.]

Most people opt to carry on the strong side (though it’s better to be able to access the firearm with either hand) and choose either an inside-the-waistband (IWB) or outside-the-waistband (OWB) holster. More modern forms of concealed cnnholsters-300x169-9366591carry are the belly band, a wide elastic band around the mid-section with pockets sewn in, undershirts with sewn-in pockets, conceal-undershirts-300x225-2525149and even a band around the bicep to hold a gun under the sleeve of a short sleeved shirt.

Along with holster selection, you’ll also need to find clothes that fit well without printing, and there are a number of great dress and casual options.

Sights

Remember that previous section regarding the importance of proper bullet selection? Choosing a set of sights—the system by which you will properly deliver that bullet—is critical, and the irons that come with your gun may not be the best option for you.

It’s not always easy to find the right gun with the right sights, but the good news is that you can change the sights (or, if you aren’t up to the task, there’s likely a competent gunsmith somewhere nearby who will swap your sights for a reasonable price). I prefer a front sight that is bright green. That color seems to be the easiest for me to see in any light conditions, and fiber optic and tritium options do an effective job allowing you to shoot in near or total darkness.

But iron sights aren’t the only option. Lasers can be mounted on the rail, in the grip or even in the iron sights of your concealed carry pistol, and they are effective day or night. Today’s compact reflex optics are light and durable, and more and more semi-autos are coming optic-ready.

Home Security

The primary concern when storing a firearm in the house is access. You must make the gun rapidly accessible to those who know how to use it while keeping it inaccessible from those who don’t. A safe is a great option, but will you be able to get to that gun in a hurry?

When choosing a safe, you’ll need to decide which type of locking system you want. Traditionally, safes have had digital or mechanical dials that allow entry, but more modern safes are using RFID technology.

Coded safes are another option, allowing you to quickly enter a punch code, and biometric options that recognize your finger prints are also an option. The best safe for you depends on your preferences and your budget.

My Closing Thoughts

If you carry a gun or are considering it, I hope this article is giving you the information you need to make a wise decision. Carrying a gun for self-defense is not a choice to be made lightly. There is a huge responsibility involved with this decision.

I have been carrying a handgun for most of my adult life and, fortunately, I have never been forced to use it. I’ve read Lt. Col. Dave Grossman’s book and, believe me when I say it’s an eye-opener.

Open Carry Laws By State

Recently, as early as today, August 20, 2016, I have been researching the internet regarding “Open Carry Laws By State”. You’ll be hard-pressed to guess what I found by way of current information. But then again, maybe you won’t be surprised at all.

It was my intent to write about the open carry laws by state and cover the most recent laws. However, it looks like I would spend many long hours researching this. The article I found from Jan. 2016 was published in “The Guardian” ( https://www.theguardian.com/us-news/2016/jan/15/open-carry-gun-laws-states ). This is the most current information I could find that I knew wasn’t too outdated to be useful.

The article says; “On Tuesday in Florida, state lawmakers gathered to start their 2016 session, and will soon consider two gun bills: one to allow 1.5 million Floridians with concealed-carry permits to carry their firearms openly, the other to allow guns on college campuses.Despite the gun control movement’s momentum in recent years to pass many new restrictive laws, today only Florida and four other states – California, Illinois, New York and South Carolina – prohibit open carry. The other 45 allow it to varying degrees.”

This article continues; “Even in the most open of open-carry states, gun rights advocates are scratching out new territory. Alabama, for example, has been gun-friendly since its inception. Gunpowder is baked right into the state constitution: ‘Every citizen has a fundamental right to bear arms in defense of himself or herself and the state’.”

“When Alabama’s state legislature reconvenes in February, it will consider a bill put forward by Republican representative Mack Butler, of Rainbow City, designed to allow students at universities to carry guns at school. In Alabama, the age requirement to purchase a handgun is 18, so Butler’s bill would open up the possibility of freshmen walking to class armed.”

“’I hope to eliminate every gun-free zone I possibly can‘, Butler told the Yellowhammer News a week ago.”

I read that California was the fifth state to prohibit open carry, and there are now 45 states allowing it. From my own experience, having lived in Ca. at the time, and carrying a CCW, they passed the law prohibiting open carry on Jan. 01, 2012, and prior to this date, open carry in Ca. meant “you can legally carry an unloaded gun openly”. Unloaded meant you could carry the gun openly as long as you had NO AMMO IN YOUR POSSESSION at the time. To my way of thinking, an ‘unloaded’ gun is as effective for self-defense as a rock laying on the ground. They both have the same function.

Texas passed a law allowing open carry earlier this year and is embroiled in a debate about what they call “campus carry”. Some folks want to have it legal for faculty, staff, and students to carry concealed on campus, to include the classrooms.

There is now an ongoing debate between open carry and concealed carry folks. Open carry people say it deters crime, while concealed carry people say it makes the open carriers the first ‘targets’. Also, the concealed carry folks are upset because business owners that were never bothered by customers with concealed firearms are now concerned about their clientele getting nervous at the sight of guns being freely displayed. Now the business owners are putting up signs forbidding weapons in their establishments, so concealed carry people have lost some the freedom they enjoyed previously.

“Places that were mum or fine on concealed carry and now in an over PC backlash, has excluded decades-long CC in some of the most popular corporate chains,” a gun owner posted on TexasCHLforum.com, a site for firearm enthusiasts. “And many other mom and pops who would rather not have the Instagram photo freaks clicking pics in front of their menu’s so I guess congrats to us, we cut off our nose despite our face.”

Adam Winkler, a law professor at UCLA and author of Gunfight: The Battle over the Right to Bear Arms in America, said the gun rights strategy purports to turn back the national clock to a time when Americans lived closer to the land, defended themselves from harm, lived more independently – and carried six-shooters on their hips wherever they strode.

So why the push for college campuses?

“That’s where the young people are,” Winkler said. They are forming ideas about what’s acceptable in society and what’s not. But more than that, he said, “It’s a sign of the success of the gun rights advocates. There is little left for them to win. The campus is one of the few contested battlegrounds left.”

That sort of frustration will fade, according to the strategy described by Winkler, as the population grows more accustomed to guns. Once people stop feeling afraid, the “no guns” signs will come down.

“This is about normalizing guns,” he said.

“Right now I’d say the gun rights people are winning,” said David Helton, an optometrist in Atmore, Alabama, who carries guns for hunting and self-defense. “It’s because the federal government is hamstrung – a lot of states are just doing what they want.”

As you can see by this, the debate over gun control, open carry vs. concealed carry, CC on campuses, and the rights & laws from state to state will apparently keep changing from now until who knows when. There can’t really be an article written to cover the open carry laws by state until all the states adopt what is being called “Constitutional Carry” or “State Reciprocity“. This would be the same as your driver’s license being accepted by whatever state you happen to drive through regardless of where it was issued.

So you see, the gun laws in this country are changing almost as fast we change our socks. It’s nearly impossible to be totally current with all the changes being made in every state.

We have all heard about ‘Black Lives Matter’ and how they are impacting the country and political climate. How they are disrupting political rallies, blocking traffic to Donald Trump’s speeches, and just overall making a pest of themselves. All under the guise of their 1st amendment rights of free speech.

But it doesn’t stop there. They are violating the laws and depriving other citizens of their rights to listen to the speeches and move around the cities freely. This is all in the news media coverage almost on a daily basis, so none of this will be a surprise to anyone reading this article. In my humble opinion, all lives do matter, and I don’t believe this is a racist statement. My life matters as much as the black men and women protesting in the street. We are all human beings and children of God, so we should all have the same value. We all matter equally.

We are told to stop saying “all lives matter”. We are being told black lives are held at a lesser value than others, so my question is; If black lives really are so important to the black community, why are so many blacks being killed by other blacks? If blacks are so much more important than they ‘feel’ the police are valuing them, then why do they destroy their own communities during a protest they start themselves?

I have yet to hear a rational answer to this question that has been asked a hundred times or more.

A young black woman in a video says “of course, all lives matter, but we should not be killed by police without reason(?) just because we are black”. My response goes right back to the previous paragraph. Why are so many blacks being killed by blacks? The video by Bill Whittle gives stats of black-on-black killings much higher than police-on-black killings. Why is this?

You are walking from the mall out to your car in the distant corner of the parking garage. Someone is walking behind you carrying something you think might be used as a weapon against you while you have an armload of Christmas gifts. Then you notice that guy isn’t alone. There are three others with him and they are wearing hoodies and walking toward you from different directions. Does the hair on the back of your neck start to stand up and you get a shiver?

You are now in “condition orange”. You don’t know what these guys are thinking, but they might be wanting what you have in your arms. As you reach your car, you turn to look at them and think they’re going to attack you. You pull your concealed firearm and tell them to “back off or you might get hurt”. They do as you say and walk in a new direction. You feel satisfied they aren’t going to attack someone with a gun in his hand.

You’ve done yourself a good deed. You stopped the attack and prevented a harmful encounter. The security guard saw what happened. He approaches you to ask what was going on. He stops the other guys and talks to them as well to get both sides of the story.

A couple months later, you’re in the courtroom, neck-deep in debt,  facing a five-year jail term for Felony Menacing (“brandishing”, as it’s called in some states). A guilty verdict would make you a “felon for life”, and you will never again be allowed to own a firearm.

Your defense attorney makes a case that you were protecting yourself from a potential threat from overwhelming odds. The jury seems sympathetic to your case until the prosecuting attorney shows them a “facebook post” from you. A friend told you he felt uncomfortable when a group of youths was watching him intently. In response to his comment, you wrote back; “If that were me, those little sons of bitches would wet themselves when they saw my gun”. The judge asks you, “Which is it, sir? Were you lying then, or are you lying now?”

It’s a little scary to think about, but this is the way the courts and the DA’s really work.

Congress and the American Bar Association say it’s legal to use anything you post online against you in court…and you can be absolutely sure the DA will use whatever he can find.

Here Are Some Ways To Avoid a “Guilty” Verdict
If You’re Forced To Pull The Trigger

  1. Life is precious and shooting someone is traumatic- no matter how much you think they deserve it. Ask anyone who’s ever shot someone and watched them die from their bullet. Pulling the trigger may be necessary to save your life or the life of someone you love- butthe psychological scars are forever.
    Don’t be too flippant with the comments you make when just talking with your friends.
  2. Save the sarcasm and jokes. When you do post to social media, remember sarcasm can’t be seen on a computer screen or when it’s “printed out” on paper.When the DA or Judge holds up a printed copy of your blog comment about “those little bastards pushing up daisies”,

    they won’t read it with grins and giggles. They’ll read it as though you’re the neighborhood gun nut that shouldn’t be trusted.

  3. Reverse your public image. So now you’ve done your analysis and thinking of those inappropriate comments you’ve made.
    You can redeem yourself. It actually does help if you post more comments on how your views and opinions have changed.
  4. Adopt a Legal Mind-Set. It’s totally irresponsible for any gun owner to not completely understand the correct legal justification of pulling your gun in any circumstance. Most gun owners have a hard time with this, even the ones who profess to be “experts”.
    Attorneys will run you ragged in court unless you have a pretty good knowledge base of the laws regarding using your weapon in self-defense.

The “Reasonable Man Doctrine” is what allows the prosecuting attorney to denote your frame of mind before the shooting as evidence against you. But you can use the same Doctrine in your favor as well by showing your efforts to take your legal responsibilities seriously.

One way is to take a legal class that can show proof of your prior knowledge before you were attacked. These classes can be hard to find and quite expensive, but there are alternatives. One alternative is the training you can get from the US Concealed Carry Association. They have an abundance of information in all phases of concealed carry and can offer self-defense insurance coverage.

Train, Train, and Train Some More

You literally can’t get too much training in how to use your gun and, equally important, when to use it, or not. You truly must know the root of the law regarding the use of a gun in a self-defense situation. And be careful what you say on social media.

How Does The National Instant Criminal Background Check Work

Just what is it and how does it work? Does it work at all?

In my view, the way it’s written, it works just fine. It’s not perfect or the best that can be achieved, but for what it is, it works. The big problem I see is the lack of use and confidence in the system.

If a criminal (or most commonly referred to as the ‘bad guy’) tries to buy a gun through the conventional method of going through a licensed retailer, he will be identified as a bad guy and won’t be able to purchase the gun legally. So he goes about it illegally and still gets the gun.

It also works in the case of the mentally challenged individual, providing this individual has been vetted and registered as ‘mentally challenged’. However, there have been a lot of people registered this way mistakenly. It seems as though anyone who has ever been seen my a mental practitioner can be on this list whether or not he/she has been deemed mentally challenged. Therein lies a huge problem.

There has been a number of  ‘mass shooters’ with no background of mental deficiency listed anywhere in the public records. or even in private records as far as the NICS (National Instant Criminal Background System) has known. They can ‘slip through the cracks, so to speak, simply because they are not ‘documented’ as mentally unsound. If a mental practitioner doesn’t put this person on a list denoting a lack of proper mental awareness, the NICS has no way of knowing about it. Therefore, neither does the legally licensed gun retailer.

It is my humble opinion that any mass shooter is mentally unsound just by virtue of them being a mass shooter. If they had any real sense about them, they would not be going around wanting to shoot people. it is also my humble opinion that a ‘criminal’ is a criminal because he/she is mentally “deficient, challenged, unsound”, or any other words you may choose to describe them.

The term developmental delay is popular among caretakers and parents of individuals with intellectual disability because delay suggests that a person is slowly reaching his or her full potential rather than being disabled”.

For example, mental retardation in some contexts covers the whole field but previously applied to what is now the mild MR group. Feeble-minded used to mean mild MR in the UK, and once applied in the US to the whole field. “Borderline intellectual functioning” is not currently defined, but the term may be used to apply to people with IQs in the 70s. People with IQs of 70 to 85 used to be eligible for special consideration in the US public education system on grounds of intellectual disability”.

What is a Criminal History Check?

There are a large number of companies doing criminal history checks all over the country world (I would guess). A few of them advertise free background checks, but most of them will charge a fee for anyone to purchase a criminal history on just about anyone. Background checks have become quite common and routine in much of the world of business. They are also required by many rental agencies.

A criminal history search can be performed anywhere in the USA.  However, some states do not offer a statewide criminal background check, and instead only make them available at the county level.  Each state in the United States of America is comprised of counties, cities, towns, parishes and communities.  Criminal records are determined usually at the county level, as that is where the US court system typically begins.

What Does The FBI Say About This?

“As a result of the passage of the Gun Control Act of 1968, certain individuals, such as convicted felons, were prohibited from possessing firearms. To strengthen federal firearms regulations, the Brady Handgun Violence Prevention Act of 1993 (Brady Act) required the U.S. Attorney General to establish the National Instant Criminal Background Check System (NICS) for Federal Firearms Licensees (FFL) to contact by telephone, or other electronic means, for information to be supplied immediately as to whether the transfer of a firearm would violate Section 922 (g) or (n) of Title 18, United States Code (U.S.C.), or state law”.

“The FBI developed the NICS through a cooperative effort with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF); the Department of Justice; and local and state law enforcement agencies. On November 30, 1998, the NICS, designed to immediately respond to background check inquiries for prospective firearm transferees, was activated. For an FFL to initiate an NICS check, the prospective firearms transferee must complete and sign an ATF Form 4473, Firearms Transaction Record. The ATF Form 4473, which collects the subject’s name and descriptive data (e.g., date of birth, sex, race, state of residence, country of citizenship), also elicits information that may immediately indicate to an FFL the subject is a prohibited person, thereby negating the need to continue the processing of the background check. When an FFL initiates an NICS background check, a name and descriptor search is conducted to identify any matching records in three nationally held databases managed by the FBI Criminal Justice Information Services (CJIS) Division”.

So How Does The National Instant Criminal Background Check Work?

I think it works the way it was intended. The criminals are not allowed, by law, to purchase firearms legally. And they are prevented from doing just that. So, as I said before, they get them illegally. This is where things get a bit ‘sticky’.

The anti-gun crowd says we need more effective laws, like ‘Federal Background Checks’. We ALREADY HAVE THEM, folks!! And they work! Law Enforcement is where the problem comes from. It’s not the police being deficient, it’s the Justice System. The courts and the Obama

administration are being very lacking in the true design and purpose of the Justice System. They are supposed to lock up the criminals and not permit them to infiltrate the honest law-abiding society again unless they are TRULY rehabilitated.

Responsible law-abiding citizens are not the problem, but they are the ones receiving the short end of the stick when the ignorant anti-gunners try to pass more unnecessary laws. These additional “stupid” laws just penalize the good folks and do absolutely nothing to prevent the bad guys’ criminal behavior.

“On January 4, 2016, the Department of Health and Human Services (HHS) moved forward on the Administration’s commitment to modify the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule to expressly permit certain covered entities to disclose to the National Instant Criminal Background Check System (NICS) the identities of those individuals who, for mental health reasons, already are prohibited by Federal law from having a firearm.

This modification better enables the reporting of the identities of prohibited individuals to the background check system and is an important step toward improving the public’s safety while continuing to strongly protect individuals’ privacy interests.

The final rule gives States improved flexibility to ensure accurate but limited information is reported to the NICS.  This rulemaking makes clear that, under the Privacy Rule, certain covered entities are permitted to disclose limited information to the NICS.  The information that can be disclosed is the minimum necessary identifying information about individuals who have been involuntarily committed to a mental institution or otherwise have been determined by a lawful authority to be a danger to themselves or others or to lack the mental capacity to manage their own affairs.

It is important to note that the vast majority of Americans with mental health conditions are not violent and that those with mental illness are in fact more likely to be victims than perpetrators.  An individual who seeks help for mental health problems or receives mental health treatment is not automatically legally prohibited from having a firearm; nothing in this final rule changes that.  HHS continues to support efforts by the Administration to dispel negative attitudes and misconceptions relating to mental illness and to encourage individuals to seek voluntary mental health treatment.  Learn more about mental health resources and recovery at http://www.mentalhealth.gov.”

What’s It Really All About?

I’m not sure the majority of the citizenry have any clue of what’s really going on with all this. It kind of looks like the government and the so-called elite (anti-gun activists) just want us completely disarmed. That’s just not gonna happen, folks!! The Constitution and Bill Of Rights have provided for this and the responsible citizens will not stand for it. Responsibly armed citizens make up an extremely large part of this country’s population. We (and, yes, I am one of them) will not give up our arms for the bureaucratic nonsense coming from government executive orders.

This disagreement has been going on for many years, decades even, and I really don’t see an end to it in the near future. When you look at the statistics, President Obama has been the nation’s best gun salesman we have ever had. Since the anti-gun movement increase during his terms in office, the gun owner population has risen dramatically. Gun sales have hit all-time highs for the last several years.
